Are drivers are required to register for the Clearinghouse?
Drivers are not required to register for the Clearinghouse. However, a driver will need to be registered to provide electronic consent in the Clearinghouse if a prospective or current employer needs to conduct a full query of the driver’s Clearinghouse record—this includes all pre-employment queries. See 49 CFR 382.703(d).
A driver must also be registered to electronically view the information in his or her own Clearinghouse record. See 49 CFR 382.709.
Registered drivers will have their Clearinghouse accounts and contact preferences set up, allowing them to quickly respond to query requests from employers.

The FMCSA has a minimum random drug-testing requirement of 50 percent of the average number of driver positions, and a minimum of 10 percent for random alcohol testing. In the event either of these percentages is changed by the FMCSA, the change is published in the Federal Register. The DOT requires a five-panel test for controlled substances, including amphetamines and methamphetamines (including MDA, MDEA, and MDMA), cocaine, marijuana, opiates (opium and codeine derivatives), and phencyclidine (PCP) .

DOT-REGULATED

Some railway workers, pipeline workers, aviation workers, and marine industry workers may also be included in this category.
NON-REGULATED/WORKPLACE:
If you and your staff are not affected by the US, DOT laws, you are an employer who is not regulated. We call these businesses "Workplace" customers.
